Copyright is a bundle of rights, including the right to reproduction, adaptation, and translation of the work that is vested by the law upon the creators of literary, dramatic, musical and artistic works and the producers of the cinematographic films and sound recordings.

The Copyrights Act, 1957 provides a consolidated framework to deal with issues relating to copyrights in India.

What are copyright objections?

During the period of 30 days after the applications are filed, there is a chance that the registrar may raise certain objections to the application.

The objection may be with respect to any deficiency of documents or where similarities are found with an existing similar work. The registrar shall inform the same to the applicant and request for clarifications.

Why file response to copyright objection?

It is very important to file a response/reply to the copyright objection letter as it's a legal obligation on the part of the applicant. If the reply is not filed within the stipulated period, then the registrar may cancel the copyright application and update it as ‘rejected’ in the copyright journal. Thus, to avoid such results, it is very important to respond to the copyright objection letters.

How to file a response to a copyright objection letter?

There is no fixed format to draft a reply to a copyright objection. It depends on case to case. However, it may be noted that a copyright objection letter is a legal letter and thus the reply to it has to be drafted with the proper legal knowledge and drafting skills.
